1. Agreement to Terms

By accessing or using BC Apps Market (the "Service") at bcappsmarket.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. BC Apps Market is operated by BCAppsDev LLC ("we", "us", "our").

2. The Service

BC Apps Market is an online marketplace where users can browse, purchase, and download software applications. We sell our own apps and also allow third-party developers to list and sell their apps through our marketplace.

We do not create, develop, or own third-party apps listed on the marketplace. Third-party apps are the sole responsibility of their developers.

3. Accounts

Customers do not need an account to purchase apps. Developers who wish to submit apps must register an account with a valid email address. You are responsible for maintaining the security of your account credentials.

4. Purchases and Payments

Payments are processed by Stripe, Inc. We do not store your credit card information. All payment data is handled securely by Stripe in accordance with PCI-DSS standards.

• One-time purchases grant you a perpetual license to download and use the app
• Subscriptions (WDT, WOTB) are billed annually until canceled
• You can cancel subscriptions at any time through the app or our website

5. Third-Party Apps

Important: Third-party apps are not created, reviewed, endorsed, or guaranteed by BCAppsDev LLC.

• We perform automated content scanning and manual review of submissions
• However, we cannot guarantee that any third-party app is free of bugs, malware, or inappropriate content
• You download and use third-party apps at your own risk
• Any issues with a third-party app should be directed to the app's developer, not BCAppsDev LLC

6. Developer Obligations

Developers who submit apps to the marketplace agree to:

• Own the rights to the apps they submit or have authorization to distribute them
• Ensure their apps do not contain malware, viruses, or malicious code
• Ensure their apps do not contain nudity, sexual content, hate speech, racism, Nazi symbols (including swastikas), graphic violence, terrorism promotion, or illegal drug content
• Ensure their apps do not infringe on any third party's intellectual property
• Provide accurate information about their apps
• Respond to user complaints and bug reports in a timely manner
• Indemnify BCAppsDev LLC against any claims arising from their apps

We reserve the right to remove any app at any time, without notice, for any reason.

7. Commission and Payment

For third-party app sales:

• Paid apps must be priced at $2.99 or more
• BCAppsDev LLC charges a 20% commission on the pre-tax app price
• Developers receive 80% of the app price minus Stripe processing fees, refunds, chargebacks, and applicable adjustments
• Sales tax collected from customers is not included in developer earnings
• Free apps use no Stripe checkout and have no marketplace commission
• Developer payment accounts and standard payouts are managed through Stripe Connect

7a. Definition of "Free" Apps

"Free" means free to download only.

A free app may still:

• Require in-app purchases to unlock full features, levels, or content
• Offer only a limited-time free trial, after which payment is required
• Display advertisements of any kind (banners, interstitials, rewarded ads)
• Collect data from the user's device, including usage data, location, contacts, device identifiers, or other information
• Contain "freemium" mechanics that limit functionality without payment

BCAppsDev LLC does not control, review, endorse, or profit from ads, in-app purchases, or data collection in third-party apps.

Any advertising, in-app purchases, or data collection within a third-party app is the sole responsibility of that app's developer. BCAppsDev LLC is not responsible for:

• The content or behavior of advertisements shown in third-party apps
• What data third-party apps collect or how they use it
• Charges incurred through in-app purchases made within third-party apps
• Any harm caused by third-party app data collection or advertising practices

Users should review each app's privacy policy and permissions before installing. Parents should monitor downloads and in-app purchases by children.

8. License Keys and Subscriptions

For subscription-based apps (WDT, WOTB), a license key is generated upon purchase. This key is tied to your Stripe subscription. If you cancel your subscription, your license becomes invalid and the app will stop working. License keys are non-transferable and may only be used on one device at a time.

9. Prohibited Conduct

You agree not to:

• Reverse engineer, decompile, or disassemble any app
• Redistribute, resell, or share license keys or purchased apps
• Submit apps containing malware, spyware, or malicious code
• Submit apps containing illegal, hateful, or sexual content
• Attempt to disrupt or hack the Service
• Use the Service for any illegal purpose

If you believe content on BC Apps Market infringes your copyright, please see our DMCA Policy for instructions on filing a takedown notice.

11. Disclaimer of Warranties

THE SERVICE AND ALL APPS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not guarantee that any app will function correctly on your device. We do not guarantee that third-party apps are free of malware or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, BCAppsDev LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or any app purchased through it.

This includes, but is not limited to:

• Damages from malware or viruses in third-party apps
• Damages from data loss or device malfunction
• Damages from inability to use a purchased app
• Damages from inappropriate or offensive content in third-party apps
• Any damages exceeding the amount you paid for the app

Our total liability for any claim shall not exceed the amount you paid us for the product or service giving rise to the claim, or $10, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless BCAppsDev LLC, its officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

Developers specifically agree to indemnify BCAppsDev LLC for any claims arising from their submitted apps, including copyright infringement, malware, or inappropriate content claims.

14. Termination

We may terminate or suspend your account and access to the Service at any time, without notice, for any reason, including violation of these Terms. Developers may have their apps removed and accounts banned for submitting prohibited content.

15. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. The "Last updated" date above reflects the most recent revision.

16. Governing Law

These Terms are governed by the laws of the United States and the state in which BCAppsDev LLC is registered. Any disputes shall be resolved in the appropriate courts of that jurisdiction.
